Indecent Exposure
Elements
- A person
- Exposes his anus or any part of his genitals
- With intent to arouse or gratify the sexual desire of any person
- Acts recklessly about whether another is present who will be offended or alarmed by his act
Penalty
Class B misdemeanor — up to 180 days county jail + up to $2,000 fine (§12.22).
Enhancements
If victim is a child under 17, charge as Indecency with a Child under §21.11 (felony). Defendant required to register as a sex offender on conviction (Tex. Code Crim. Proc. ch. 62) for two convictions of indecent exposure.
