Violation of a Protective Order
Elements
- In violation of an order issued under specified provisions (e.g., Tex. Family Code ch. 85, ch. 7B Code of Criminal Procedure magistrate's order for emergency protection, or similar)
- A person knowingly or intentionally
- Commits family violence, communicates a threat, goes near a residence/place of employment, possesses a firearm, or otherwise engages in conduct prohibited by the order
Penalty
Class A misdemeanor — up to 1 year county jail + up to $4,000 fine (§12.21). Mandatory minimum confinement of 30 days if the actor has been previously convicted two or more times of an offense under §25.07 or has violated the order by committing assault or stalking.
Enhancements
Third-degree felony if the actor has been previously convicted two or more times of violating §25.07 or §25.072, OR violated the order by committing an assault or stalking — 2 to 10 years TDCJ + up to $10,000 fine (§12.34). If a deadly weapon was used, additional enhancement may apply.
