Deadly Force in Defense of Property
Justified ONLY when the actor would be justified under §9.41 AND reasonably believes deadly force is immediately necessary to prevent imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime, OR to prevent escape with the property.
To prove this offense, the State must establish each of the following elements: §9.41 underlying justification (must be entitled to use non-deadly force first); Reasonable belief deadly force immediately necessary; To prevent imminent arson, burglary, robbery, aggravated robbery, theft at night, or criminal mischief at night, OR to prevent escape with property; Reasonable belief property cannot be protected by other means OR using less force would expose actor or another to substantial risk of death or SBI.
The base classification is Justification defense (narrow), with possible enhancements depending on the conduct, victim, location, or prior history of the actor.

Worked examples
Under §9.42, deadly force in defense of property is justified ONLY when:
- Any property is being damaged
- The actor would be justified under §9.41 AND reasonably believes the deadly force is immediately necessary to prevent the imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime, OR to prevent the other's escape with the property; AND reasonably believes the land/property cannot be protected by any other means OR using less force would expose the actor or another to a substantial risk of death or serious bodily injury Correct
- The property's value exceeds $30,000
- Only at the actor's home
SCENARIO. A homeowner in Texas hears a thief breaking into a parked car in his driveway at 1 AM. He runs out and shoots the thief. Apply Texas law.

Under §9.42(2)(B), deadly force in defense of property is justified to prevent the other's IMMEDIATE FLIGHT from the property when:
- The property is damaged
- The actor reasonably believes the property cannot be otherwise protected, AND there is reasonable belief that flight is happening immediately, AND the use of less force would expose the actor or another to substantial risk of death or SBI Correct
- Always after a felony
- Anytime someone runs
